Marriage (Spouse) Visa Japan
If you are married with Japanese National for living in Japan, there are many steps such as documentation for collecting necessary documents and submission to several government offices.
At first, the couple have to register their marriage at the first country, and then the marriage must be registered to the second country as well. For example, please imagine that a wife is a Japanese National and a husband is a foreign national intend to be married with each other and wish to stay together in Japan.
Normally, the couple will submit the marriage notification with necessary documents to the city office in Japan. However, the certificate of the eligibility of the marriage such as AFFIDAVIT or Certificate of No Impediment is required when submitting the marriage notification. After 7 to 10 days of the notification, the marriage will be registered to Japan side, and then a copy of family register (koseki touhon) will be issued from the city office. A ‘koseki touhon’ is the proof which certify the completion of their marriage in Japan.
After obtaining a ‘koseki touhon’, you may go to the ministry of the foreign affairs of Japan in order to authenticate a ‘koseki touhon’ or arrange an Apostille. Otherwise, you may go directly to the embassy, a consulate to register their marriage.
After registration of the marriage to the both country, you have to change the status of residence to Spouse of Japanese to the Immigration Bureau. If you get married with permanent resident, you will change to Spouse of Permanent Resident.
Visa Application to Immigration Bureau
If you would like to stay in Japan after marriage with Japanese Nationals or permanent resident, you must acquire marriage visa, what is called spouse of Japanese Nationals or spouse of permanent residence, etc. after completion of marriage for both countries. Although lots of legal documents must be prepared for the marriage steps, most difficult obstacle is marriage visa application to Immigration Bureau.
We have interviewed clients who received refusal for marriage visa application in many case under the reason that Immigration suspects the marriage is not real under the grounds such as the age difference, usage for marriage brokers, cannot talk with each other because of language barrier, one or both have experience of divorce, etc.
Of course, preparation of legal documents is necessary, but the most important thing is to explain in Japanese Language precisely in the documents such as how you both met and the date, and place, the person who introduces both, etc. so that the examiner of Immigration can believe the marriage is real.
Additional document may be asked sometimes from Immigration Bureau by mail, by phone. Please be noted that this notification is supposed to the last chance to prove the truth of your marriage, therefore you should keep in mind that all you can do is to collect evidence and make a statement in the documents to convince examiner of Immigration the marriage is real even though no one knows the result of examination is heaven or hell no matter how you insist in the document.
